1. Delivery period and availability
Your order will be processed immediately on
receipt by FIRSTGATE or PayPal. After
you have got the file you need to register the eBook by following the instructions displayed when you open the file for the first time. When you've sent the requested information your ID will be sent to via email or within the next 2-3 working days.
1.a By ordering an eBook you have to identify yourself to FIRSTGATE Internet AG, Im MediaPark 5, 50670 Köln, www.firstgate.de, who is doing the clearing procedure for us and in our name.
1.b FIRSGATE will send you a confirmation of the order and a bill (including tax) in our name. With your online confirmation of the order and the confirmation-mail of Firstgate the contract is concluded.
1. After the payment we will get a notifikation by PayPal and will send you the file within the next 2-3 working days.

2.a We supply the items ordered on account via

4. Cancellation/Returns
You can return an eBook within 14 days (this
does not apply to eBooks if they have been registered).

5. Retention of title
The books and articles delivered remain the property of
the publishing company until all claims of the
publishing company against the customer have
been settled.
6. Protection of data privacy
We are not storing any personalized data, for
any further purposes. The data FIRSTGATE or PAYPAL needs
for the payment are not given to us with the
exception of cancelled orders or when they can't
get the money. The data for the registration
procedure are not personalized (there is only
a machineID, a productID and an orderID stored
by Fileopen), and not given to us. This means
the customer is anonymous to us.
8. Venue and applicable law
German law shall apply. Venue shall be Frankfurt
am Main.

Hinweis gemäß Fernabsatzgesetz:
1. Bei entsiegelten, resp. autorisierten Datenträgern
besteht kein Widerrufsrecht (§ 3, Absatz
2, Ziffer 2 FernAG).
Der vollständige Text des § 3 Fernabsatzgesetz (Widerrufsrecht, Rückgaberecht) lautet wie folgt:
Fernabsatzgesetz § 3 Widerrufsrecht, Rückgaberecht
(1) Dem Verbraucher steht ein Widerrufsrecht nach § 361a des Bürgerlichen Gesetzbuchs zu. Die Widerrufsfrist beginnt abweichend von § 361a Abs. 1 Satz 3 des Bürgerlichen Gesetzbuchs nicht vor Erfüllung der Informationspflichten gemäß § 2 Abs. 3 und 4, bei der Lieferung von Waren nicht vor dem Tag ihres Eingangs beim Empfänger, bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor dem Tag des Eingangs der ersten Teillieferung und bei Dienstleistungen nicht vor dem Tag des Vertragsabschlusses; die Widerrufsbelehrung bedarf keiner Unterzeichnung durch den Verbraucher und kann diesem auch auf einem dauerhaften Datenträger zur Verfügung gestellt werden.
Das Widerrufsrecht erlischt
1. bei der Lieferung von Waren spätestens
vier Monate nach ihrem Eingang beim Empfänger
und
2. bei Dienstleistungen
a) spätestens vier Monate nach Vertragsschluss oder
b) wenn der Unternehmer mit der Ausführung der Dienstleistung mit Zustimmung des Verbrauchers vor Ende der Widerrufsfrist begonnen hat oder der Verbraucher diese selbst veranlasst hat.
(2) Das Widerrufsrecht besteht mangels anderer Vereinbarung und unbeschadet anderer gesetzlicher Bestimmungen nicht bei Fernabsatzverträgen.
1. zur Lieferung von Waren, die nach Kundenspezifikation
angefertigt werden oder eindeutig auf die persönlichen
Bedürfnisse zugeschnitten sind oder die
aufgrund ihrer Beschaffenheit nicht für
eine Rücksendung geeignet sind oder schnell
verderben können oder deren Verfalldatum
über-schritten würde,
2. zur Lieferung von Audio- oder Videoaufzeichnungen
oder von Software, sofern die gelieferten Datenträger
vom Verbraucher entsiegelt worden sind,
3. zur Lieferung von Zeitungen, Zeitschriften
und Illustrierten,
4. zur Erbringung von Wett- und Lotterie-Dienstleistungen
oder
5. die in der Form von Versteigerungen (§
156 des Bürgerlichen Gesetzbuchs) geschlossen
werden.
(3) Anstelle des Widerrufsrechts nach Absatz 1 und 2 kann für Verträge über die Lieferung von Waren ein Rückgaberecht nach § 361b des Bürgerlichen Gesetzbuchs eingeräumt werden. Absatz 1 Satz 2 und 3 Nr. 1 gelten entsprechend.

1. In any case access has to be restricted to your library or local area network or via the IP range of your library or institution.
2. It is not allowed to share the file with other libraries not mentioned in the licence agreement. In this case please contact for a group licence.
3. Duplicating the ebooks is allowed only for backups. The file has to be protected against unallowed copying and sending to other terminals/personal computers outside the network. This means sending via email, copying on removable storage medias like a CD, DVD, or any other disk or memorystick.
4. Access from more than one user is allowed.
5. If you want to share your digital publications with other libraries or if you are part of a cooperation a group licence is needed. The price depends on the number of libraries or institutions.
6. If it will be necessary to convert the file into a different digital format the user is allowed to do so while preserving the character of the eBook as a work which means not to decompile it, e.g. divide it into pieces.
